that litigious society that you mention could make up enough claims to move this to a class action law suit, where the real winners will be the lawyers and owners.

1) no one has talked suit and it is unlikely that a few hundred defective loaders with no personal injury or even operational failure is going to get product liability lawyers excited.

2) only the lawyers win in most class action suits.

3) I for one would prefer this thread not turn into a soap box about law suits. That is not the point. We're discussing a loader repair program and why it has not yet been announced.

I think you could even take the words "class action" out of that sentence and it would still be correct. :D

:D But I will restrain myself and resist posting off topic lawyer jokes.

Okay, I'm sorry. I was just trying to lighten up things a little (not lower any importance) and I figured lawyers were fair game.

Alright, I'll take the bait. What do you call 1000 lawyers at the bottom of the Atlantic Ocean? A good start.

To keep this TBN focused, here is one I got off the internet that at least has the word "Tractor" in it:

A hotshot New York City lawyer went duck hunting down in South Texas. Before long, the lawyer shoots and drops a bird, but it falls into a farmer’s field on the other side of the fence. As the lawyer begins to climb over the fence, an elderly farmer drives up on his Kioti CK20 tractor and asks the lawyer what in the blue blazes he thinks he is doing. The lawyer responds, “I shot a duck and it fell in this field and now I’m going to retrieve it.”

The old codger replied, “You better hold your horses there sonny. This is my property and you’re not coming over here.”

The lawyer, more than a bit miffed at the old farmer’s gruff attitude, responded, “Look old timer, I’m one of the best trial lawyers in America and if you don’t let me get that duck, I’ll sue you and take you to the cleaners.”

The farmer smiles at the lawyer and says, “Apparently you don’t know how we do things down here in Texas. We settle disagreements like this with the Texas three kick rule.”

The lawyer asks, “What in the heck is the Texas three kick rule?”

“Well,” says the farmer, “first I kick you three times and then you kick me three times, and so on, back and forth, until someone gives up.”

The lawyer quickly thought about the proposed contest and decided that he could easily take the farmer and agreed to abide by the local custom. The farmer then slowly climbed down from the tractor and walked over to the city feller. His first kick planted the toe of his boot into the lawyer’s groin and dropped the lawyer to his knees. His second kick nearly wiped the lawyer’s nose off of his face. The lawyer was now flat on his back when the farmer’s third kick to the kidney nearly caused the lawyer to give up. The lawyer then summoned every bit of his will and managed to get to his feet and said, “Okay, you old coot, now it’s my turn.”

To which the old farmer coolly replied, “No, I give up. You can have the duck.”

Seems that everyone has a lawyer joke and finds that lawyers are fair game to pick on. Then when something happens, such as what has happened to 40Chicks, seems that all of TBN tells him to go to a lawyer. Same for the fellow that has a problem with a cement contractor.... Go to a lawyer is the common thread of the advise. IslandTractor, please tell me what you do when you wind up with a legal problem and who do you turn to? Do you go into court and represent yourself? When you are making a large purchase, such as a home or business, do you seek the advise of an attorney? When you sign a binding agreement that requires you to make a substantial investment of capital, do you go it alone, or do you have an attorney look over the papers first before signing it? Yes... attorney's. They are all the butt of everyones jokes, but who do we go to when we need advise to save ourselves from bankruptcy or other legal problems. It sure isn't the tractor dealer down the street.
I only pointed out the possibility of what can happen when a manufacturer has there head in the sand. I didn't say that it will happen, but I did say that it can happen. Do we need to have the first human casualty, injury, or death before Kioti will notice? I certainly hope not, because then it will be too late. Even Ford learned that bitter lesson with the Pinto. Remember that one? The lawyers are the ones that brought it to light of the American public. Do you know how many complaints it takes to the U.S. Government Consumer Product Safety Commission before they open an investigation? It isn't many, and it doesn't take a lawyer to do that. The consumer can do it from the comfort of there home by computer. The complaint process is very simple.

Dusty, (?AKA Junkman). Lighten up. We're just having a little fun here and passing the time until I can call Kioti for an update on the loader situation on Monday. Don't you Yankees have any sense of humor?:)

Last post that is sort of off the subject; I did spend some time at law school, I have family members who are attorneys, most of my friends are attorneys, and my best friend owns his own law firm. Having said that, I'll tell you that their favorite jokes are lawyer jokes. It sort of cuts the stress levels they have I suppose. It's like everyone complaining about insurance companies. That's fine, but if your house burns down, to whom would you turn?? Some professions have built in perks as well as built in drawbacks. If you can't take both, get out of the profession. And, that line was from a councilor the first day of law school. ;)

Its just unfair that only 98% of lawyers give the rest such a bad name.
