When she made her pretrial diversion agreement with the county. An assistant DA called my wife, and told her the neighbor lady was to start making payments to us in September. But when we got the paper work it says she has 180-days to pay in full. That will be December 27th.

I hope the system works for you SA. Taking the high road is fine but you should not dismiss low tactics to defend you property rights. If someone piled crap on my property, I would (and have) pushed it back.

Can you sell that debt to a collection agency? Sure you won't get the full amount, but, at least you will get something and not have to deal with her about it if she doesn't pay you anything.

Thanks for the update. It doesn't sound like you are too worried about getting the money, and I'm glad of that, because I think she'd rather do time at this point. She doesn't have a full deck.

According to the paper work we received from the prosecutor's office. If she doesn't completely comply with the pretrial diversion agreement. She will be convicted of malicious mischief in the third degree without a trial. That could be up to 364 days in jail and/or a $5,000.00 fine plus costs and assessments, and that the judge can impose any sentence up to the maximum, no matter what the prosecuting authority or the defense recommends.

If your neighbor runs her mouth in front of the judge, as she has apparently done before, she will get the max.

have the DA on speed dial and his office FAX # ready (as well as the # for the enforcement end of things at the court house )....
and expect the "Xmas season / flu / not well" excuses to be used ....

It is sad our legal system is in such bad shape, this should have been a quick open and closed case.
