OK, I understand what you're saying now
. But my point is, the neighbor admitted guilt to a law officer. Not that I know anything about the law:confused3:, but my guess is, she is screwed.

We are a no fault state, but that doesn't sound like the right application of that statute in this case. Not 100% on that though. You can file a lien in this state with no proof of anything on her property though I'd keep it to the amount to real damage etc though, so when title goes through it you can collect. Assuming she ever sells... Bet she'll live there until death just to get your goat though.

Yes we have a lien on her property.:thumbsup: That was automatic when we won the adverse possession case. She appealed that to the state court of appeals. But she went at that without a lawyerWe are a no fault state, but that doesn't sound like the right application of that statute in this case. Not 100% on that though. . So she put her legal mind up against the most senior judge in Kitsap County. Guess how far she got with her appeal?:laughing:

I've been here 36 + years. I've always said there was something in the water here in Kitsap county. Laziest people I ever seen in my life! And the worst drivers I've ever seen! If 90% of them had to drive I-5 they would be pulled over and beat to death.

The wife and I went to court today. We sat behind the prosecutors table. Before the judge came in, I over heard the neighbor's attorney tell the prosecutor he wanted to go to trial in June. The prosecutor asked why so long. He replied because of his calendar. My wife went up to the prosecutor, and asked what was going to happen. He replied the neighbor only wants to pay $1,000.00 for our fence. Later the neighbor's attorney came back to the prosecutor's table to hand him some papers. He made the statement that his client did not do this with malice:shocked:. The prosecutor laughed at him!
Once the judge called the neighbor, I didn't hear why, but for some reason we will return next Wednesday at 10:30 A.M. The prosecutor turned around in his chair and asked if we would take less money for the fence, we said no! She owes us money now, and she has no intension of paying for this either. So the soap opera will continue next week!

Oh yeah, she will play games with the court system as long as they allow her to.
That's the way I see it too. I'm actually surprised the prosecutors talk to us so much between cases.
I'm waiting to see how this plays out. Then I'll decide if I need to hire an attorney, and sue her in civil court.

Dont think so.. As it stands now, the state is the one prosecuting which means she would owe the state. If she loses and cant pay, it'ss either be put as a lein on the home and the state is higher than Sheild Arc in that regard, or if they put it as taxes and dont pay, the state will take the home and put it up for tax sale. Either way, the state wins the property.

Its always easy to say "make her pay". The problem is to actually make her pay. Just because you win a judgement doesn't mean you will actually get paid. If the person doesn't have any money or refuse to pay then you still have to go back to court to get a judge to make them pay. Some states will garnish your wages to allow you to be paid but what if she doesn't have a job.

I'd hope she has to pay for her attorney but knowing this area, I have a feeling the county gave her one.
The lien one way or another will have to be dealt with even upon her death so patience is the key.

Yes she has stopped for now, but the reason why. On March 5th when I went to court The prosecutor told me, the prosecutor's office put in place for 2-years a no contact order, so the neighbor can not have any contact with my wife. He said if the neighbor comes on our property within this 2-year period to call the sheriff's office, they will come out and arrest her, the court will convict her without a trial. I hope when this is all said and done they keep this no contact order in place for a few years. :crossfingers:

I know that area well. I drove all the piling for the new elevated I-90 from the east channel bridge to 405, through the Bellevue swamp in the early 1990s.
