For those of you still interested in this thread.
Went to court today. The neighbor's court appointed attorney:shocked: ask the judge for a 60-day postponement. Before court her lawyer came up to me in the hall way and wanted to negotiate a settlement, to put a close to everything today. I told him she broke the law, and he needed to talk to the prosecutor.:talktothehand:

Postponing sounds like a tactic to try to wear you down, they hope you'll get tired of it, give up and go away.

Actually the way I see it, I'm not even in the equation. It's between her and the prosecutor's office. Which I don't understand them at all, we have written several letters, some hand delivered to the prosecutor's office begging for information of what is going on. Not one phone call, or letter from the prosecutors. My tax dollars at work I guess!:mad:
Funny she doesn't have money for an attorney for this, but did when she sued me for adverse possession.:rolleyes:

If you are allowed to settle. Figure up all what this mess she caused has cost you in $$ ,headache , etc, etc, and give him a figure to settle. On the other hand,,If she has a court appointed attorney, It's doubtful she has any $$ to pay

She already owes me $400.00 + 12% interest from the adverse possession lawsuit. We have made up our minds that if we don't get paid for a new fence, we will hire an attorney and foreclose on her property. The lawyer we had through the last lawsuit wanted to do this, but our last state governor made him a judge in superior court.

Sounds like a plan... though I dont know how you could foreclose, maybe a lien..

You should consider a settlement. Don't put too much faith in the vagaries of the jury system. Bird in the hand and all that…..

One that will repay you for what you have been out and then some written guarantee from her that she will not harass you in the future. Recommend you consult an attorney on drawing that document up so that if she breaches it she will be exposed, contractually, for substantial damages. That way you will have a strong, negotiated civil remedy as well as the threat of criminal charges if she should breach it.

I believe I read somewhere in all of this, that you have spent 30 K or over 30 K . You say she owes only $400.00 + interest ?? I must have missed something somewhere:confused3:

He said he lives in a "no fault state" later. Good luck shield arc. Hope you get your judgment but will probably take the sheriff to evict her after the foreclosure.

Ok, I guess that's the part I missed. If I had already spent that much $$..If possible, I would foreclose on her too. Don't fool with the small stuff.....Go for the Jugular :thumbsup:
