Yes, we are still interested. I feel for you man. I have a ongoing dispute ($$) with a neighbor and I know it wouldn't be worth taking to court for the very reasons you are dealing with right now.

ME! ME!

She is to pay the courts the $3,475.20 for my fence.

Pardon my cynicism, but is the court then going to disperse that to you? Or is her offense against the State Of Washington, and you can go to heck?

They came back in and her lawyer told the judge she wants to go to trial.:shocked: So we have another court date of March 19, 2014.

It's only going to get worse for her from here.

I would think that this would be a separate civil suit, while this case is criminal--hence the "it's between the State and her, you have nothing to do with it," statement.

I too would be concerned about having to go through this all over again to get the money you are owed.

If this is between the state and her, and this is indeed not the civil part where you will get paid, why did you have to go to court today?

According to the prosecutor, once the court is paid then they send us a check for the fence.;)




why did you have to go to court today?
I'm only going to see what's happening, being as the prosecutor's office refuses to have any communication with us at all!:mad: Plus I love the look on her face when she sees me there.:laughing:

I guess after she is convicted, that is when you can sue for everything she has cost you right from day one? Including the 30 grand from the very first?

Except I live in a no fault state!:mad: All I'm entitled to is $200.00 for expenses, and $200.00 for legal fees. Plus 12% interest until she pays.

Now you know why she is jacking you around. She knows that she will only have to pay out a few hundred and yet it will cost you thousands to defend yourself and your property.

Good Lord!!! I read this entire saga and I'm sure glad I get along with my two neighbors. ShieldArc - you more patience than any ten people I know and a lot more $$$ to spend on attorneys. Good luck.

I'll bet she had agreed on the deal, on advise from her lawyer. Then she gets there, and goes off the deep end again...

This sounds right to me.

The prosecutor might be thinking your physical presence in the courtroom is a hindrance to your neighbor admitting guilt.

The neighbor admitted to the sheriff last summer that she cut our fence down.:shocked: The neighbor told the responding sheriff that another sheriff told her that if my fence was on her property to cut it down. The responding sheriff replied "no sheriff told you that"! "If their fence is on your property, you have to take them to court".
